The highway code prohibits the use of specific tyres. All motorists, motorcyclists, etc. must know the regulation in order to respect it in every point, without risking getting fines or causing accidents that can evolve in a negative way.
Respect the highway code it is as essential as keeping up to date with the news, given that the rules change from month to month and the law does not allow ignorance.
According to the highway code there are tires that should only be used during the indicated period. As absurd or trivial as it may seem, there is a lot of difference between one wheel and another, which has to do with grip on asphalt in winter. During the cold season the conditions of the asphalt and the tires are different.
What the Ministry of Infrastructure says about the obligation to use winter tyres
In this regard, the Ministry of Infrastructure specifies that it is mandatory by law for winter tires to be used in particular in the winter period from 15 November to 15 April. Alternatively, you must always carry snow chains with you to be fitted in case of need. All vehicles on which as of May 15th tires that do not comply with those indicated on the registration certificate are fitted, instead they risk receiving a fine ranging from 400 euros to €1682.
At risk are all cars that they are fitted with M + S winter tyres which have lower speed codes than those indicated on the registration certificate.
When it is possible to fit alternative tires without risking fines
Only in some specific cases, according to the Highway Code, it is possible to mount tires other than those indicated in the vehicle registration document. For example when the measure has been approved by the car manufacturer following the registration of the car. In this case obviously you need to update the booklet. Or when you receive the authorization from the manufacturer which allows you to mount the alternative tires.
Another case has to do with the wheel manufacturer, who has the obligation to verify the compatibility of the wheel new fit with the car. In this case, however, it is necessary to present the rim approval certificate followed by the tire specialist’s declaration to the Land Transport Department in order to be in compliance and not risk fines in the event of checks by the police. The tire fitter will check that the tire and the wheel are correctly assembled to allow for any checks carried out by the body in charge in order to proceed with the update and transcription on the registration certificate.
